Why Is Capital One Facing Congressional Scrutiny?
Capital One is facing fresh scrutiny over its decision to close accounts linked to President Donald Trump and his businesses after a Democratic U.S. senator requested details about the bank’s internal anti-money-laundering review.Senator Maggie Hassan of New Hampshire asked Capital One CEO Richard Fairbank to provide documents describing the transactions, alerts and other factors that led the bank to review the accounts. She also requested information about any related communications with law enforcement agencies or financial regulators.Hassan, the top Democrat on the Joint Economic Committee, said the information was needed for congressional oversight and wrote that “The American people deserve to know.”The request could provide more detail about why Capital One closed hundreds of accounts connected to the Trump Organization in 2021 and whether the decision resulted from standard compliance procedures or other considerations. Capital One declined to comment on Hassan’s letter. What Did Capital One Say About Its AML Review?
The Trump Organization and Eric Trump sued Capital One in March 2025, alleging that the account closures were politically motivated. Capital One has denied that claim and said its actions followed an internal review conducted by its anti-money-laundering team.In a July court filing, the bank said the accounts were closed after a careful review conducted “in accordance with bank policies and regulatory guidance.” Capital One has not accused the Trump Organization of money laundering. The Trump Organization disputes the bank’s explanation. A spokesperson said Capital One had relied on older transactions that had not previously been treated as problematic and described the AML review as a justification created after the accounts were closed. The competing explanations have made the underlying compliance process central to the lawsuit. Hassan is seeking information about which activity triggered the review, what policies Capital One applied and what findings ultimately led the bank to terminate the accounts.Investor Takeaway
The Capital One dispute goes beyond one customer relationship. Banks are under growing pressure to show that account closures are based on documented compliance and risk controls rather than political or ideological considerations, increasing the importance of clear internal records when high-profile clients are removed.
